The borrower sought to refinance the existing mortgage and secure long-term financing on the property. During the lender’s due diligence process, the Phase I Environmental Site Assessment identified a historical concern: the property had previously operated as a gas station. As a result, the environmental consultant recommended additional investigation after being unable to locate documentation confirming that the former underground tanks had been properly decommissioned. Complicating matters further, the borrower did not have records related to the tank closure.

Rather than allowing the transaction to stall, ERG leveraged its industry relationships and extensive experience working through environmental issues to obtain the necessary documentation confirming the tanks had been properly removed and decommissioned. By resolving the issue, the borrower avoided costly additional testing, potential remediation expenses, and significant delays to closing.
